Brienne S. Terril
Brienne focuses her practice on intellectual property matters, including patent prosecution and litigation across a range of technology areas, including computer security systems, encryption technologies, smart cards and biometric systems. She regularly provides counsel on patent issues relating to product and technology development and has experience prosecuting and securing patents for Internet-based advertising systems, wireless communication systems, mobile device technologies, e-commerce systems, document production systems and security and encryption technologies.
Brienne regularly conducts intellectual property transactional due diligence in an effort help venture capital funds, investors and purchasers understand the risks associated with investment in, or purchase of, companies that provide mobile communication devices, file backup services, insurance management software, computer security systems and healthcare management systems. Brienne also evaluates infringement issues and drafts patent invalidity, non-infringement and patent marking opinions for clients in various industries, including data storage media, robotics, medical devices, automotive parts and agricultural management systems. Additionally, Brienne has experience negotiating and preparing technology transfer and licensing agreements, including purchase agreements, stock purchase agreements, intellectual property assignments, software licensing agreements and security agreements and releases.
Brienne also conducts analysis of licenses governing the use and distribution of open source software, advises on the risk involved in incorporating open source software into proprietary platforms and assists clients in developing comprehensive policies for open source code compliance.
