Exempt or Non-Exempt? Overcoming Latest Employee Misclassification Challenges
Class action and collective law suits involving the Fair Labor Standards Act (FLSA) have been on the rise over the past decade. Some of these disputes result in multimillion-dollar verdicts. Around 70 percent of employers violate the FLSA's classification requirements, according to the U.S. Department of Labor. Thus, it is very important for employers to reevaluate their classification practices.
As part of the panel titled, "Exempt or Non-Exempt? Employee Misclassification Challenges," Mark E. Tabakman will discuss which employers are most likely to misclassify according to FLSA and state law, advise employers on self-auditing and help correct misclassification errors.
