Racketeer Influenced and Corrupt Organizations (RICO) for the Business Lawyer

The federal RICO and state little RICO statutes have transformed garden-variety business disputes into “racketeering” cases over the last thirty years. A statute aimed at the Mafia is rarely, if ever, used in that context today. Instead, it has become a legal weapon used to attack banks, corporations, real estate partnerships and other forms of traditional business enterprises. Although little utilized when originally enacted (even in criminal cases), it has morphed into an all-purpose cause of action with the promise of treble damages and attorneys’ fees at the end of the rainbow.
This program will explain how that transformation occurred and examine the elements of a RICO claim and defenses.
