Facing record budget deficits, federal and state officials are aggressively pursuing companies that misclassify regular employees as independent contractors. Companies that pass off employees as independent contractors avoid paying Social Security, Medicare and unemployment insurance taxes for those workers – depriving the government of revenue.

This seminar provides an overview of the standards for determining independent contractor status under a variety of laws and statutes, including the IRS test, the New Jersey unemployment test and the Fair Labor Standards Act. It also covers preparation for and representation of clients for DOL independent contractor audits.
