Debtor

Debtor representations require knowledge, experience and business savvy in order to achieve the goals a distressed business needs to achieve. The restructuring and bankruptcy team at Fox has and can apply these components to its debtor representations across a wide variety of industries. From out-of-court workouts to successful reorganizations and going-concern sales in Chapter 11, Fox has the experience, ability and depth of talent to provide excellent counsel to distressed businesses.

Creditor

We represent a variety of creditors in restructurings and bankruptcies nationwide. From unsecured creditors to special vendor creditors to service providers, Fox’s insolvency group is prepared to handle the complicated situations that creditors of distressed businesses face, which often includes balancing economic interests, strategic concerns, and future business plans and objectives.

Creditors’ Committees

Fox’s restructuring and bankruptcy team has significant experience representing creditors’ committees in Chapter 11s throughout the country and across a wide range of industries. The team draws on this experience to excel in the fast-paced and complex environment that creditors’ committees face.

Trustees

Our team represents a substantial number of Chapter 7 trustees in cases across the country. The issues encountered by Chapter 7 trustees are often different to those faced by participants in restructurings. Usually, a trustee is immediately faced with myriad urgent issues that need to be addressed quickly in order to preserve asset values for creditors. The Fox team is well equipped to handle these matters, as well as the process and difficult situations that trustees face closing complex cases and maximizing distributions.

Section 363 Transactions/Sales

We represent purchasers in 363 sales, including those involving the submission of stalking horse bids, bidding terms and auctions.
