3rd Cir.: Company Exempt from Overtime Claims of Drivers

Randall C. Schauer and Jennifer J. Hanlin were featured in the Society for Human Resource Management article, “3rd Cir.: Company Exempt from Overtime Claims of Drivers.” Full text can be found in the July 11, 2015, issue, but a synopsis is below.

The U.S. Circuit Court of Appeals, Third Circuit, recently ruled that the charter bus company Kraft’s Coaches, Inc. (KCI) does not have to pay its drivers overtime.

There is a possibility that all of KCI’s drivers could be assigned an interstate route, qualifying the drivers under coverage of the federal Motor Carrier Act, which would exempt them from the overtime compensations under the Federal Labor Standards Act and the Pennsylvania Minimum Wage Act.
