Following decades of both economic and political isolation between the United States and Cuba, presidents of the two countries seem to be working out their differences and restoring commercial as well diplomatic ties between the countries.

With a new market for U.S. companies to enter protecting trademarks poses obvious challenges. With the risk of hijacking, many American trademark attorneys suggest that, to be safe, businesses should register to file their trademarks.

“I would always suggest that they file,” said Raul J. Valdes-Fauli, an attorney atFox Rothschild LLP's Miami office. “They can file in Cuba or under the Madrid treaty. But make sure, when in doubt, to file.”
