Calif. High Court To Eye Class Waiver In Wages Case

David Faustman commented on the California Supreme Court's agreement to consider limo driver Arshavir Iskanian's, of CLS Transportation Los Angeles LLC, appeal of the decision to send his proposed wage-and-hour class action to individual arbitration.

“We would have preferred that they just not take the hearing and let the unanimous court of appeal opinion become law,” said Faustman. who represents CLS. “But there is some confusion, I think, among the active bar about some of these issues and courts of appeal have gone in somewhat different directions, and we're looking forward to the opportunity to have the Supreme Court clarify this and hopefully rule that these agreements are valid.”
