Earlier in July, the U.S. Court of Appeals for the First Circuit reversed the summary judgment ruling in favor of People’s United Bank, which does business as Ocean Bank, in a suit that was brought on by Patco Construction Co. Inc.
Scott L. Vernick, a partner and member of the firm’s Media, Defamation & Privacy practice, recently spoke to The Fraud Blog about the ruling. Vernick does not expect the ruling to have much impact.
"It's hard for me to say necessarily that you are going to see a wave of lawsuits against banks," Vernick said. "If you see it, you'll see it because it would be hard for a bank today to argue that they are not aware of the any number of cyber threats that are out there."
