Determine Whether Your Practice Faces Impending 3-day Billing Rule

William H. Maruca, a Partner and member of the firm’s Health Law Practice, was recently featured in a DecisionHealth Medical Practice Compliance Alert. Maruca offered some insight and tips for medical practices that may face the CMS' new three-day billing rule that willcomplicate billing for hospital-affiliated practices starting July 1.

The new policy change will apply to as many as half of physician practices that recent studies suggest are hospital-owned. While the policy targets wholly owned or operated practices, Maruca believes that each hospital-practice relationship is unique and determining the ownership varies on a case-by-case basis.

According to Maruca, it is important to verify your hospital’s legal relationship to your practice. In fact, if your hospital owns or operates your practice, in any way, you'll have to comply with the rule. One good place to check, according to Maruca, is by finding the person who writes the practice administrator's paychecks. If your hospital is calling the shots about employee pay and benefits or operational costs, CMS would consider your practice to be subject to the new rule.
