On October 8, 2014, a federal judge ruled that the Pennsylvania law that prohibits employers from refusing to hire workers based on prior criminal convictions that do not affect their suitability for the job does not ban employers from further questioning about those convictions.

According to the U.S. District Court for the Middle District of Pennsylvania, Schenker Logistics did not revoke its job offer to Dustin McCorkle due to the various misdemeanors that turned up on a criminal background check, but because he did not mention many of the on his job application.
