Farm Stores Cleared in Workers’ Comp Fight Dating Back to 1999

Joseph A. DeMaria was featured in the Daily Business Review article, "Farm Stores Cleared in Workers' Comp Fight Dating Back to 1999." Full text can be found in the March 2, 2016, issue, but a synopsis is below.

A Miami-Dade judge has set aside a $1.8 million jury verdict, which was to be issued to Zenith Insurance Co., and entered a final judgment in favor of Farm Stores Corp. According to the circuit judge responsible for overseeing the case, Zenith failed to present enough evidence to prove that Farm Stores was responsible for the breach-of-contract damages.

Fox Rothschild’s Joseph DeMaria represented Farm Stores Corp. in the case.

"While it is rare for a court to set aside a jury verdict, it is necessary for a court to direct a verdict for the defendant when the evidence fails to prove the elements of the claim," DeMaria said. "We are confident that if Zenith appeals, this decision is well-supported."
