Fox Rothschild LLP is pleased to announce that partners Scott L. Vernick and Mark G. McCreary have been recognized by The National Law Journal as Trailblazers in Cyber Security Law.
The distinction, part of the paper’s annual Trailblazers series, is presented to attorneys who had a significant impact in the fight against criminal cyber activity and moved the needle toward adding layers of needed data security. Honorees were selected from hundreds of nominated attorneys.
Vernick was lauded for his innovation in the data privacy field. A nationally ranked trial attorney who represents Fortune 500 companies in lawsuits that focus on privacy and data security, technology, intellectual property and health care, Vernick is Chair of Fox’s Privacy and Data Security practice. He spearheaded the creation of Fox’s free iOS app, Data Breach 411, which provides easy access to applicable state statutes and enables in-house counsel and compliance professionals in the midst of a crisis to quickly identify controlling law and relevant guidance.
Vernick has handled first-of-a-kind engagements that have helped define this still-emerging landscape for a diverse range of clients, including First Data Corporation and Banc of America Merchant Services. He has tried cases in state and federal courts across the country, and before arbitral forums. He also published a study that took the pulse of industry professionals and revealed a widespread lack of preparedness for responding to a major cyber breach. Providing clients with another useful tool, this study identified the areas most needing improvement: employee training, vendor management, systems protection and data encryption.
McCreary, who serves as the firm’s first Chief Privacy Officer (CPO), was recognized for his work in modernizing and changing the way his clients and his own law firm think about cyber security and data privacy. In his role as CPO, McCreary works to ensure that every lawyer and every client receive quick and correct answers on data security questions; that data in any client record handled by the firm is protected; that the firm’s own policies reflect best practices; and that attorneys and staff are educated on the issues.
In 2016, McCreary earned a CIPP certification from the International Association of Privacy Professionals – a highly recognized distinction that signifies extensive knowledge of privacy laws and regulations and a foundational understanding of jurisdictional laws, regulations and enforcement models or rules and standards, essential privacy concepts and principles and legal requirements for handling and transferring data.
McCreary also produced a Privacy Desk Reference, a concise set of guidelines for protecting businesses from existing and future threats and plugging existing data security holes, and is a regular contributor to the firm’s Privacy Compliance & Data Security Blog.
