Fox Rothschild Obtains Summary Dismissal of Defamation and Retaliation Claims Against Superintendents of Freehold Regional High School District

Princeton, NJ – Fox Rothschild LLP has achieved summary judgment on behalf of our clients in Martucci v. Board of Education of Freehold Regional H.S. District, et al. Partner Francis V. Cook represented the Regional High School District Superintendent and Assistant Superintendent. The dismissal was upheld on appeal by the Appellate Division of the New Jersey Superior Court.

“This is a great victory for our clients,” said Cook. “We are extremely pleased that the trial court and the appellate court both agree that these claims have no merit.”

Plaintiff John Martucci is a former tenured Administrative Supervisor with the Freehold Regional High School District. After leaving the District, he filed a lawsuit claiming defamation and violations of the Conscientious Employee Protection Action, which is New Jersey’s whistleblower statute. He contended that he was harassed and targeted for retaliation after participating in an Attorney General investigation of the School District.

The trial court granted summary dismissal of the case. Martucci then appealed. With the help of Fox Rothschild, defendants effectively demonstrated that all decisions concerning Martucci’s employment were legitimate and non-retaliatory. The appellate court agreed and affirmed the decision of the trial court.
