Fox Rothschild Successfully Represents NJ Doctor in $1.3 Million Breach of Contract Claim

R. James Kravitz, an attorney in the Princeton office of Fox Rothschild LLP, successfully represented a Wayne, NJ, orthopedic surgeon in a breach of contract claim in the Superior Court of New Jersey in which a jury awarded more than $1.3 million.

Kravitz represented Nader Fahimi, M.D., a successful Wayne, NJ, orthopedic surgeon, in a suit against Northlands Orthopaedics and Sports Medicine, P.A., which is now known as the McInerney Orthopaedic and Sports Medicine Institute, LLC, and is owned and operated by Vincent McInerney, M.D., a prominent orthopedic surgeon, who also has an office in Wayne, NJ.

The case involved multiple claims and counterclaims, as each doctor sued the other and the cases were ultimately combined. The jury deliberated for approximately two hours, after a three-week trial before state Superior Court Judge Garry S. Rothstadt. By an 8-0 vote, they returned a verdict in favor of Fahimi and awarded him $1,372,640.54 in damages. By another 8-0 vote, the jury rejected McInerney’s claim that Fahimi breached an agreement pursuant to which McInerney claimed that he gave an ownership interest in a surgical center to Fahimi.
