Governor Rick Snyder is set to be questioned under oath this morning in the Detroit bankruptcy case in what attorneys are saying is likely a historical first.
Attorneys say they know of no other case in which a state governor has testified in a Chapter 9 bankruptcy, but the state’s role in the lead-up to the bankruptcy set up under Michigan law, including the appointment of emergency manager Kevyn Orr, is unique.
Michael Sweet said union and retiree attorneys will argue “this was all pre-planned,” and “there really wasn’t good faith negotiations” with creditors, as required by law before a Chapter 9 filing.
