Fuel company LUKOIL North America is suing a gas station in Allentown, claiming that it continues to operate as a franchise, with part of the LUKOIL trade dress and colors still intact, although it is no longer a franchise, the complaint stated. Additionally, the gas station continues to sell unbranded fuel under the LUKOIL trademarks and distinctive trade dress, making customers think it is still LUKOIL gas.

The fuel company thus filed a lawsuit, claiming trademark infringement and trade dress infringement.
