Michael Lewis and Gerry Norton of Fox Rothschild’s Intellectual Property Practice Area recently were quoted in an article by Grant Gross of IDG News Service. The article, which appeared in InfoWorld, discussed the legal issues surrounding the unlocking of Apple’s iPhone from the AT&T network.
According to Lewis and Norton, unlocking the iPhone and posting code or instructions for free would likely fall under an exception to the U.S. Digital Millennium Copyright Act.
Said Lewis, “…if a hacker unlocks the iPhone, then posts the unlocking code for free, he's engaging in a legal activity and enabling others to engage in the same legal activity.”
