A Law360 piece reports that Microsoft Corp. is denying allegations it gave the U.S. National Security Agency access to its users’ communications, but attorneys interviewed say Microsoft will not be able to end the speculation until the government no longer prohibits it – and other companies – from discussing what information was shared.

“The risk of this most recent report is that it raises inconsistencies with what Microsoft has said to date,” said Vernick, a national authority of privacy law.

“In order to restore confidence and erase any discomfort, Microsoft needs to post in as many forums as it can clear, consistent, concise and easy-to-understand statements about what it is doing and what it’s not doing, assuming it can do that,” Vernick said.
