Lawyers continue to bill long after their firms go under. A court case this week will test whether creditors to a struggling firm can stake claims to the lawyers’ fees.

Geron, who is overseeing the liquidation of Thelen LLP, says the unfinished-business doctrine doesn’t threaten a client’s right to choose counsel.

“There’s no evidence anywhere in any of these cases…that client choice has been affected by the implementation of this,” Geron says.
