Partner Eileen Oakes Muskett discussed the recently a New Jersey Assembly panel's decision to approve legislation that would give adversaries in class action litigation the right to immediately appeal decisions granting or denying class certification.
Muskett, whose experience covers mass tort, products liability and pharmaceutical litigation, said companies can shoulder needless litigation fees and costs defending class actions that should have never been certified.
"This legislation would be an excellent tool to assist defense counsel in avoiding the proverbial cart getting before the horse in the course of the litigation," she said.
