The Pennsylvania Supreme Court ruled that a lower court erred when it refused to honor a noncompetition covenant that was mentioned in Pulse Technologies Inc.’s employment agreement but wasn’t mentioned in the initial offer letter, saying the offer letter wasn’t the employment contract.

“We are extremely pleased with the result of the Supreme Court’s affirmance of an employer’s ability to utilize nonbinding offer letters as a first step in the hiring process without fear of being deemed to have entered into a contract of employment,” Adam Silverstein said.
