Years of commitment to helping nonprofit organizations realize their goals has landed Richard S. Caputo, a partner in the Exton office of Fox Rothschild LLP, a new role as chair of the firm’s Nonprofit Organizations Group, effective immediately.
Caputo succeeds Steven Levitt, who served as chair of the Exempt Organizations Practice (now known as the Nonprofit Organizations Group), in leading and managing the members of the group, among other responsibilities.
“Rich will enhance the group’s ability to provide counsel on the business and legal complexities nonprofits face in today’s economic and regulatory environment,” said Mark Silow, administrative partner of the firm. “His leadership abilities will be an asset to the team’s growth.”
In his practice at Fox Rothschild, Caputo focuses on tax-exempt organizations, trust administration, Orphans’ Court litigation and estate planning. He forms public charities, private foundations and supporting organizations; addresses tax-exempt compliance issues such as self-dealing, taxable expenditure responsibility, excess business holdings and intermediate sanctions; assists corporate fiduciaries in obtaining tax-exempt status for their charitable trusts; and represents corporate fiduciaries in Orphans’ Court Proceedings.
Caputo is experienced in preparing Form 1023 applications, Petitions for Adjudications, Petitions to Terminate, Petitions to Reform, Cy Pres Petitions, Guardianship Petitions and Non-Judicial Settlement Agreements, structuring compensation arrangements and preparing estate planning documents.
A regular speaker on topics concerning charitable trust administration and philanthropy, Caputo regularly presents to tax-exempt clients and corporate fiduciaries and has spoken for the Berks County Estate Planning Council, Chester County Estate Planning Council, Montgomery County Estate Planning Council, Philadelphia Estate Planning Council, the Committee of Banking Institutions on Taxation, the Fiduciary Education Foundation, the PBA Wealth Management & Trust Conference and the Pennsylvania Bar Institute. In September, Caputo participated in the panel discussion, “Sound Judgments, Smart Decisions: An Organizational Perspective for Senior Nonprofit Leadership,” where he was joined by some of the Delaware Valley's most experienced nonprofit leaders in discussing how nonprofits can support their management and boards’ ability to make good decisions.
Caputo is a member of the American Bar Association, the Tax-Exempt Organizations Committee of the ABA, the Pennsylvania Bar Association and the Berks County Bar Association. He also serves on the advisory board of The Pennsylvania State University Berks Campus and is the president and a director of The Berks County Chapter of the Pennsylvania State University Alumni Association.
Caputo received his LL.M. in Taxation from Villanova University School of Law in 2001, his J.D. from The Dickinson School of Law in 1997 and his B.S. from The Pennsylvania State University in 1994.
