Third Circuit Rules Against Class of Drivers Seeking Overtime Pay

The federal appeals court sided with the lower court’s previous ruling, affirming that the drivers of a charter bus company called Krapf’s Coaches, Inc. (KCI), are not entitled to overtime pay.

The appeals court affirmed that the Motor Carrier Act exemption applies to the plaintiffs and that the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act therefore do not apply to KCI’s drivers. This is due to the fact that some of the drivers travel across state lines.
