The practice of tipping has come under scrutiny in recent months after a New York restaurant banned tipping and the New York Court of Appeals issued an advisory opinion clarifying the legal standard that would determine employee eligibility for sharing tips.

“In theory, no one could be happier than me if we could eliminate tipping altogether,” said Carolyn Richmond. But abolishing the practice would not halt the lawsuits, Richmond believes.

In order to really address the issue, Richmond says Congress needs to update antiquated labor laws. “We have this crazy roadmap of different laws that aren’t always in sync,” she said. “It’s a question of overhauling where we’ve seen there is abuse.”
