Town Wants To Ban Facebook Comments?

Anniston, AL plans to install a new social media policy that states employees who identify themselves with the city are prohibited from making negative comments about Anniston on social media sites. Gregg Jarrett of Fox News calls on Scott L. Vernick to comment on whether this proposal is a violation of the First Amendment.

Vernick says somebody forgot about the First Amendment. “A police officer in Anniston doesn’t lose his First Amendment rights when he checks in at the station in the morning,” says Vernick. “Government employees in particular have First Amendment rights, and this policy by Anniston is just particularly overbroad. The fact of the matter is that people are free to go on Facebook and disclose that they are an Anniston employee and say what they want within certain parameters.”
