Tripped Up by Recorded Calls, Litigators Appeals SEC Banishment

Ernest Badway commented on the case between attorney Steven Altman and the SEC regarding the SEC's ability to regulate the bar.

Badway said a win for the SEC in the D.C. Circuit could bolster the commission's pursuit of attorneys on ethics charges. He said he is concerned the commission will turn zealous advocacy into obstruction of justice.

"My fear is the next case we'll see will involve a lawyer who was strenuously arguing for his or her client in an enforcement investigation," said Badway. "The entire [Altman] case is troubling to me."
