Privacy Notice

Fox Rothschild LLP (“Fox Rothschild”, “our”, “us” or “we”) takes user privacy very seriously. We recognize that your privacy is a high priority, and we are committed to protecting it. This Privacy Notice (this “Policy”) provides an overview of what information Fox Rothschild may collect from you, and how we may use it. We pledge that we will take reasonable steps to ensure that your Personal Information (as defined herein) will only be used in ways that are in compliance with this Policy.

This Policy is in effect for any web page, mobile application, third-party social media site, email list, onsite electronic data collection, generic information and Personal Information collected and/or owned by Fox Rothschild, including but not limited to the Fox Rothschild website located at, no matter the method of collection (e.g., mail, facsimile, sign-up/sign-in page, survey), including collection through this website and any online features, services and/or programs offered by Fox Rothschild (collectively, the “Web Properties”).

Notwithstanding the foregoing, this Policy is not applicable to any other web pages, mobile applications, social media sites, email lists, generic information and Personal Information collected and/or owned by any entity other than Fox Rothschild.

Information Collected

Fox Rothschild may collect two types of information when you visit the Web Properties: personal information and browsing information.

(1) Personal Information

In order to participate in certain features, services and/or programs of the Web Properties, we may require that you provide us with certain specific personal information, which may include, among other things (collectively, “Personal Information”):

  • contact information(e.g., your name, mailing address, telephone number, email address);
  • demographic information (e.g., date of birth, gender, marital status);
  • resume information (e.g., education, work and military history, legal work eligibility status); and/or
  • other information specific to you.
  • your Internet Protocol (or IP) address, Unique Device Identifier, protocol and sequence information;
  • browser type;
  • browser language;
  • domain name system requests;
  • browsing history (including time spent at a domain, time and date of your visit);
  • number of clicks;
  • hypertext transfer protocol headers;
  • application client and server banners;
  • operating system fingerprinting data; and/or
  • similar behavioral and usage information.
  • information we receive from you, or on your behalf, through forms you complete, or if you contact us, for example to raise a query;
  • information we receive from you through the Web Properties;
  • information we receive from your computer or mobile device;
  • information we receive from our partners or service providers; and
  • information we receive from other sources, as permitted by applicable laws, rules and regulations.

You can choose whether or not to provide us with this information, but if you choose not to provide any required information, your experience on the Web Properties may be diminished and some features may not be available or may not work as intended.

(2) Browsing Information

Fox Rothschild may obtain non-individualized, generic information about you when you visit the Web Properties. This may include, among other things (collectively, “Browsing Information”):

Our servers automatically log each visitor to the Web Properties and collect and record certain Browsing Information about each visitor. The Browsing Information reveals nothing personal about the user and includes only the generic information described in the definition of “Browsing Information.” We may use this information to examine our traffic in the aggregate, but we do not collect and evaluate this information for individuals.

How Information Is Collected

We may collect Personal Information about you from the following sources:

Cookies: Fox Rothschild may use “cookies” to keep track of your visit and use of the Web Properties. A cookie is a small piece of data that your browser stores on your computer’s hard drive and is used to collect information, such as identifying those areas of the Web Properties that you have visited in the past in order to enhance your next visit to the Web Properties. If you would prefer not to receive cookies, you may be able to alter your browser’s configuration to refuse cookies.

Web Beacons: The Web Properties may also contain electronic images known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third-party advertisers. These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Web Properties and activities associated with the Web Properties.

Unique Identifier: Fox Rothschild may assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Web Properties and some of the electronic communications you receive from us. We keep this information for our internal use, and this information is not shared with others.

Purpose and Use of Information Collected

We may receive information about you in connection with a request from you and/or providing legal services to you. We may also, now or in the future, collect names and/or email addresses for the purpose of maintaining a mailing list regarding our services, developments in the law, events, publications, trainings and similar information in which we believe you would have an interest. Fox Rothschild does not use your Personal Information collected through the Web Properties for commercial or marketing purposes without your consent or except to provide you the services you request from us or as part of a program or feature for which you will have the ability to opt-in or opt-out. Non-identifiable information about you may be used for the purpose of improving the features and functionality of the Web Properties and otherwise for our internal business purposes.

When Information Is Disclosed By Fox Rothschild

In addition to the other times or occasions on which we might disclose information about users of the Web Properties, we might also disclose information when required by law or in the good-faith belief that such disclosure is necessary to: (1) comply with a legal process and applicable laws; (2) enforce this Policy; (3) respond to claims that information provided from or on the Web Properties violates the rights of third parties; or (4) protect the rights, property or personal safety of Fox Rothschild, its users or the public.

We use reasonable precautions to keep the information that is disclosed to us secure. We may provide Personal Information and/or Browsing Information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with our Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures. The use of your information by one of our trusted business partners may be subject to that party’s own Privacy Notice.

We may share Browsing Information with third parties to demonstrate the usage patterns for Fox Rothschild’s advertisements, content, functionality promotions and/or services on the Web Properties.

We also reserve the right to disclose Personal Information and/or Browsing Information to take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Web Properties, and to protect the rights, property or personal safety of Fox Rothschild, our users or others. We reserve the right to transfer your Personal Information, as well as any information about or from you, in connection with the merger, sale or other disposition of all or part of Fox Rothschild’s business and/or assets. We also cannot make any representations regarding the use or transfer of your Personal Information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors. Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties (including other users of the Web Properties) that receive any of the information that is disclosed to us.

Employment Opportunity Information Collection

For individuals interested in job opportunities with Fox Rothschild, the Web Properties may allow prospective employees to request additional job opportunity information or submit a response to a job opportunity. The Web Properties may be used to collect Personal Information from prospective employees for human resources recruitment purposes. By submitting any of the foregoing information, you consent to its dissemination to, and use by, us and our affiliates. The foregoing also applies to job application inquiries that you may transmit to us other than through the Web Properties.

Information From Children

The Web Properties are not intended or designed to attract children under the age of thirteen (13). We do not collect personally identifiable information from any person that we know to be under the age of thirteen (13). You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Policy, and to abide by and comply with this Policy. In any case, you affirm that you are over the age of 13, as THE WEB PROPERTIES ARE NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY HIS OR HER PARENT OR LEGAL GUARDIAN.

Parents and legal guardians should be aware that this Policy will govern our use of Personal Information, but also that information that is voluntarily given by children – or others – in email exchanges, bulletin boards, or the like may be used by other parties to generate unsolicited communications. We encourage all parents to instruct their children in the safe and responsible use of their Personal Information while using the Internet.

Privacy Outside the Web Properties

The Web Properties may contain various links to other websites, including links to various third-party service providers. Fox Rothschild is not and cannot be responsible for the privacy practices or the content of any of those other websites. Please check with those websites in order to determine their privacy policies and your rights under them.

European Union Users

If you are visiting us from the European Union, please note that, we may collect, transfer, and continue to use your Personal Information outside the European Union for use for any of the purposes described in this Policy. By using the Web Properties and providing us with your Personal Information, you consent to our collection, transfer, and continued use of your Personal Information in accordance with this Policy.

Information Security

We make every effort to ensure that information collected through the Web Properties is not lost, misused or altered inappropriately by administering security measures. However, all information transferred over the Internet can potentially be accessed by unauthorized parties; therefore, Fox Rothschild cannot guarantee the security of your data transmitted to the Web Properties.

Choices With Your Personal Information

Whether you submit any Personal Information to Fox Rothschild is entirely up to you. You may decide not to submit Personal Information through the Web Properties, in which case Fox Rothschild may not be able to provide certain services to you.

You may opt out of any disclosure or use of your Personal Information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by following the instructions at the end of this Policy, or by following the procedures set forth in an electronic communication from us, if applicable. There are some uses from which you cannot opt-out, such as our use of information about you in connection with providing support that you request for the Web Properties, or Fox Rothschild retaining your files, or a copy of your files, related to providing legal services to you.

Access and Correction

Please contact us in the manner specified at the end of this Policy to access your Personal Information in our possession and correct inaccuracies of that information in our records. We ask individuals to identify themselves and the information requested to be accessed and amended before processing such requests, and we may decline to process requests in limited circumstances as permitted by applicable privacy legislation.

Your California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide personal information in connection with obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2014 will receive information regarding 2013 sharing activities).

“Do Not Track” Signals

Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, Fox Rothschild currently does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. Social Features

Certain functionality on the Web Properties is specifically designed to permit interactions that you initiate between the Web Properties and third party websites or services, including third party social networks (“Social Features”). Examples of Social Features include enabling you to transmit content to the Web Properties from your account on a third party website or service, and to “like” or “share” our content on the Web Properties to other websites or services.

If you choose to use Social Features, information you post or provide access to may be publicly displayed on the Web Properties or by the provider of the Social Feature that you use. Similarly, if you post information on a third party platform that references Fox Rothschild (e.g., by using a hashtag associated with Fox Rothschild in a tweet or status update), your post may be published on the Web Properties in accordance with the terms of the third party website or service. Also, both Fox Rothschild and the third party may have access to certain information about you and your use of the Web Properties and the third party site or service. In addition, we may receive information about you if other users of a third party website give us access to their profiles and you are one of their “connections,” or information about you is otherwise accessible through your “connections” web pages, profile pages, or similar pages on a social networking or other third party website or interactive service.

The information we collect in connection with Social Features is subject to this Policy. The information collected and stored by the third parties remains subject to those third parties' privacy practices, including whether the third parties continue to share information with us, the types of information shared, and your choices with regard to what is visible to others on those third party websites or services.

Ethical Obligations

Fox Rothschild, and its affiliates and employees, abide by and respect all ethical obligations applicable to us and them. Nothing in this Policy is intended to or shall denounce, diminish or replace any of such foregoing ethical obligations.

Your Consent To This Policy

By using the Web Properties, you consent to the collection and use of information by us as specified above or as we otherwise see fit unless you inform us otherwise by means of the procedure identified below. If we decide to change this Policy, we will make an effort to post those changes on this web page so that you will always be able to understand what information we collect, how we use that information and under what circumstances we may disclose that information to others.
