Businesses Beware: A New State Tax Bill May be in the Mail

Fox attorneys Elizabeth Sigety and Eleanor Vaida recently offered a word of caution to readers of the Business World Times in their article, “Businesses Beware: A New State Tax Bill May be in the Mail,” which appeared in the December 2007 edition.

Sigety and Vaida discuss the imposition of taxes on out-of-state businesses “whose only activity in the state involves the use of an intangible asset, such as a franchise, trademark, patents, goodwill or service mark.”

The authors caution franchisers and licensors to “carefully examine the tax decisions of states where they wish to franchise or license their intellectual property.”
