Court Seals Confirmation Proceedings because of Confidentiality Clause

In Decapolis Group, LLC v Mangesh Energy, Ltd a federal trial court in Dallas recently sealed award confirmation proceedings ostensibly subject to the 1958 Convention On the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention) on the grounds that:

  • the underlying contract contained a confidentiality clause; and
  • the award contained sensitive business and strategic information.
