DOL Modifies Workplace Posters, Effective Aug. 1, 2016

August 8, 2016Alerts Labor and Employment Alert

The U.S. Department of Labor announced last week that, effective August 1, 2016, employers must post updated versions of two posters: the Minimum Wage Poster and the Employee Polygraph Poster. The lack of advanced notice has left many employers unaware and out of compliance with federal posting requirements.

Here is what employers need to know about the mandatory changes:

Minimum Wage Poster

Several mandatory changes were made to this poster, including:

  • New information discussing the consequences of incorrectly classifying workers as independent contractors;
  • New information relating to the rights of nursing mothers;
  • Updated information regarding enforcement by the DOL; and
  • Revised information relating to tip credits.

Employee Polygraph Protection Act Poster

This poster was updated to reflect changes to the appropriate contact information for the DOL and to remove reference to the penalty amount for violation of the law.

Here is what employers need to do about the mandatory changes:

Immediately download and post the Minimum Wage Poster and  the Employee Polygraph Poster for free from the DOL’s website.
