When you’re looking for a misplaced item, inevitably you’re asked: “Where did you last have it?” And, often, by looking in those logical places, you find what you’re looking for. Why, then, when you hire a team of lawyers to represent you in a lawsuit, do you allow them to look at every document when searching only for the relevant ones? You don’t look in your shed when you are looking for a lost kitchen utensil, do you?

Before the advent of electronic discovery, armies of lawyers would sit in dimly-lit back rooms going through boxes and boxes of documents to find the handful of key papers that would decide the case. Labels and file folders helped lawyers look for key documents but, in most cases, every document was reviewed. And, if you’ve ever hired a lawyer by the hour, we don’t have to tell you that those reviews were expensive.
