New York State Court Finds Construction of an Unpermitted Boat House Did Not Constitute a Crime

The State of New York Essex County Court was faced recently with an issue of first impression--namely whether an owner of real property or a building contract is criminally liable because they allowed construction of an unpermitted boat house within the waters of Lake Placid. Fortunately for building owner, the court found that there was no criminal liability.
