Accompanying the recent expansion of protected classifications under the New Jersey Law Against Discrimination (the “LAD”) is a new notice requirement. “Individuals who express or identify with the opposite sex” are now among the protected classes of employees under the LAD. These are individuals who have or are perceived as having a gender related identity or expression, whether or not stereotypically associated with a person’s assigned sex at birth, including transgender status, as expressed by clothing, hairstyle, name, mannerisms, and identifying pronouns, among other ways. Employers may not discriminate against applicants or employees on this basis. The New Jersey Anti-Discrimination poster now includes this newly-protected classification, and all New Jersey employers, including unions and employment agencies, are required to display the updated poster as of June 17, 2007. Employers also should incorporate this classification into their Equal Employment Opportunity policies, hiring materials, and diversity and harassment avoidance training.
