Biography

Andrew is widely regarded as an aggressive and creative litigator who provides strategic resolutions to complex commercial and construction disputes, land use matters and criminal defense cases.

Andrew’s clients include businesses engaged in a wide variety of industries as well as individuals facing allegations of white-collar offenses, fraud and other matters.

Reported Cases

  • Motorworld, Inc. v. Benkendorf, 228 N.J. 311 (2017)
    (Successfully represented Chapter 7 Trustee at trial and before the New Jersey Supreme Court which reversed the decision of the Appellate Division and reinstated the verdict of the Law Division, determining that all elements of a fraudulent transfer had been established at trial under the Uniform Fraudulent Transfer Act, including that the debtor corporation did not receive reasonable equivalent value for the disputed transfer of assets.)
  • Pagano Company v. 48 South Franklin Turnpike, 198 N.J. 107 (2009)
    (Successfully represented commercial real estate broker at trial and before the New Jersey Supreme Court which reversed the decision of the Appellate Division and reinstated the verdict of the Law Division, relative to the liability of a property owner to pay commissions upon the assignment of commercial lease agreements.)
  • The Cerebral Palsy Center v. Borough of Fair Lawn, 374 N.J. Super. 437 (App. Div. 2005) (Successfully represented a school for children with severe physical handicaps in challenging a municipal ordinance which fee-shifted the costs of a public advocate to applicants appearing before the municipal planning and zoning boards as being in violation of the Municipal Land Use Law.)
  • State v. Capaci, 260 N.J. Super. 265 (App. Div. 1992) (Successfully challenged a municipal ordinance which the Appellate Division deemed invalid that imposed upon property owners an obligation to remediate lead paint prior to the transfer of title at closing.)

  • Asbury Park Entertainment Facilities v. 208 Main Street, LLC, et als. (Successfully represented a commercial property owner in action arising from the trespass of an adjacent property owner during construction that resulted in damage to the structural foundation of a historic 5-story building.)

    (Successfully represented a commercial property owner in an action determining the rights of the parties under a redeveloper agreement.)
  • 715 Partners, LLC v. GS Assignment, LLC
    (Successfully defended the purchaser of commercial property in an action asserting breach of an assignment of a contract of sale for the property.)
  • Curcio Scrap Metal, Inc. v. Borough of Saddle Brook
    (Successfully challenged municipal ordinance imposing onerous regulations on operators of metal scrap recycling facility.)
  • Six Ten Bangs, LLC v. 601-603 Liquor License Partnership, LLC. et als. (Successfully defended action asserting claims of discrimination under the New Jersey Law Against Discrimination.)

    (Successfully obtained approvals and a use variance for a charter school to operate in the City of Asbury Park.)

    (Successfully obtained approvals for 60-unit residential development in the Asbury Park Central Business Redevelopment Zone.)
  • Asbury Festhalle and Biergarten. Asbury Park, New Jersey
    (Successfully obtained a plan amendment and approvals for a 16,000 SF Biergarten in the Asbury Park Central Business Redevelopment Zone.)
  • 550 Cookman Avenue, Asbury Park, New Jersey
    (Successfully obtained approvals for mixed-use development in the Asbury Park Central Business Redevelopment Zone, which includes the House of Independents Theater.)

    (Successfully obtained approvals for a mixed-use development to repurpose and rehabilitate the historic Kinmouth Building and the Savoy Theater located in the Asbury Park Central Business Redevelopment Zone.)

Prior to joining the firm, Andrew was a partner at Forman Holt Eliades & Youngman LLC. He was previously a partner at a boutique litigation firm for many years.

While in law school, Andrew was a law clerk to the Honorable Frederick W. Kuechenmeister of the Superior Court of New Jersey.
