An automobile dealer filed suit against a North Palm Beach police officer, claiming that the officer falsely told the state that he was a bad driver.

Dunkel filed the lawsuit on behalf of the automobile dealer. The report was filed under a state law that allows any “physician, person or agency” who believes a licensed driver lacks the physical or mental ability to drive to alert the Florida Department of Motor Vehicles and have the individual retested.

The automobile dealer suspected that the DMV report was made as a result of personal issues the police officer had with him, but was unable to prove this based on the Florida law that allows the names of those who file bad driver reports with the state to be kept confidential.
