Barbara is an intellectual property attorney who focuses her practice in medical device technology. She has more than 25 years of experience counseling clients in intellectual capital management and strategy. Barbara regularly advises medical device companies on patent prosecution and procurement, technology acquisitions, infringement and validity issues, risk analysis and competitive assessment. She also has broad experience in intellectual property due diligence, freedom-to-operate opinions, patent and technology licensing agreements and co-development alliances.

Barbara has significant experience related to the 2011 America Invents Act, including post-grant reviews, inter partes reviews involving concurrent litigation and fast-track prosecution.

Representative Matters

  • Responsible for the portfolio strategy and management of more than 1,000 patents and patent applications worldwide.
  • Lead patent counsel in an inter partes review challenging the validity of a patent asserted against Select Comfort Corp., in concurrent litigation in which the patent owner dismissed the patent from suit.
  • Lead patent counsel in inter partes review 2014-01419 Tempur Sealy International, Inc., Petitioner v. Select Comfort Corp., Patent Owner, successfully defending the patent owner against a challenge to the patent asserted against the petitioner.
