What You Need to Know About Indemnification of HR Service Contracts
HR services contracts often contain indemnification language. In recent cases, there have been real world circumstances where decisions about hiring actions have shown that these indemnification provisions, and actions or omissions by both the client and the provider, can create legal complications. Who is liable: the provider or the client? Can the potential liability be shifted in an indemnification provision, including in the Fair Credit Reporting Act context?
