DirecTV Gets Ill. Wage-and-Hour Suit Tossed

A wage-and-hour suit alleging DirecTV LLC and contractor DirectSat USA LLC misclassified technicians as independent contractors in order to avoid overtime and other benefit obligations has been dismissed by an Illinois federal judge, who ruled the technicians’ suit did not describe a relationship with the company that would qualify them as employees eligible for such benefits.

The judge dismissed with prejudice claims filed under the Illinois Employee Classification Act, ruling the law was meant to protect workers in the construction industry. The suit’s other claims filed under the Fair Labor Standards Act were dismissed without prejudice.
