Biography

Dan represents a variety of health care providers, including hospitals, physician groups, pharmacies and clinical laboratories. His practice focuses on business transactions and complex regulatory matters relating to Medicare and Medicaid compliance, including billing and reimbursement and compliance with the Physician Self-Referral (Stark) Law and Anti-Kickback Statute. Dan counsels clients with respect to HIPAA compliance, practitioner/facility licensure, health plan contracting and regularly drafts and negotiates clinical trial agreements. An experienced corporate lawyer, Dan also advises health care providers in mergers, asset acquisitions and joint ventures. He regularly assists clients on structuring health care business operations as well as negotiating employment and independent contractor arrangements.

Dan also has significant experience with zoning matters and regularly works with developers and other project proponents to obtain land use entitlements from local agencies. Ancillary to this work is obtaining necessary environmental approvals for brownfields redevelopments and other intensive uses. Dan’s projects include the Sacramento Railyards, a 220-acre brownfield site in downtown Sacramento.

Dan was of counsel at Smith Moore Leatherwood LLP, which combined with Fox Rothschild in 2018.

Beyond Fox Rothschild

Dan frequently speaks on issues affecting the health care industry, including provider contracting strategies, changes to reimbursement rules, and federal health care fraud enforcement activity.

Dan serves on the Board of Directors of the Physicians’ Care Clinic of DeKalb County and on the Atlanta Metro Chamber of Commerce’s Bioscience Leadership Council. He also served as a member of the leadership team of For Art's Sake in 2011 for the City of Sacramento.
