Ethics 1: Ethical Issues to Consider in Representing School District Clients

Special education litigation can lead to difficult ethical dilemmas for practitioners. Mark will apply ethical rules to scenarios special education attorneys frequently face, including simultaneously representing multiple school districts or educational service agencies, understanding the extent of zealous advocacy, communicating settlements to school boards and even terminating the client relationship. Using the Model Rules and real case circumstances, you’ll work through these and other troublesome topics.

When Retaliation Claims Spring From Special Ed Disputes

While many districts consider their risk for discrimination claims, a retaliation claim may catch them unaware. Citing recent case law, Mark will explore retaliation claims filed under Section 504 and the First Amendment against districts involved in special education disputes. He’ll provide practical considerations for you to share with your district clients in the heat of due process or a difficult IEP meeting. You’ll take away best practices that help districts recognize, respond to and reduce claims of retaliation.
