Litigation, bankruptcy likely to be hot practices in 2009

Local law firm chiefs differ on many points, but most concur that litigation and bankruptcy are the practice areas sure to see increased action in 2009, given the dicey economy.

“We’ve seen a notable uptick in litigation over the past six months,” said Jay Marinstein, managing partner of Fox Rothschild LLP’s Downtown office. “In a tough economy, companies that have claims that have merit are sometimes faster to pull the trigger to file litigation instead of going through drawn-out negotiations. As a result, these cases are getting filed faster. And there are cases where companies are suffering economically and want to point the finger and try to recover money from other businesses they have relationships with.”

Marinstein said more meritless claims are filed and tried by courts at a faster rate than he’s seen over the past decade.
