Due to COVID-19, EEOC Suspends Issuing Case Closure Documents

The U.S. Equal Employment Opportunity Commission (EEOC) announced on April 7 that, due to the COVID-19 pandemic, it has temporarily suspended issuing case closure documents, like right-to-sue notices, unless requested by the claimant.

Nothing in the EEOC’s announcement precludes claimants from filing new EEOC charges. But the announcement does indicate that, during the COVID-19 pandemic, parties to a pending or newly filed EEOC matter should not expect the EEOC to reach a cause determination or issue case closure documents, such as a right-to-sue notice, unless requested by the claimant. 

The new policy is temporary and the EEOC is expected to lift the moratorium when it determines that the effects of the COVID-19 pandemic have sufficiently subsided to allow the agency to resume its administrative process. Notwithstanding, the EEOC has not suspended its investigations, so employers involved in active matters should continue to check the Respondent Portal for pertinent updates and should timely respond to any inquiries from the EEOC.
