Mike is a litigator, strategist and adviser to sophisticated financial services firms, investors, investment banks and the cannabis industry. He practices regularly in Colorado, California, and New York, and appears in state and federal courts and in FINRA arbitration nationwide. Named a 2017 “Lawyer of the Year” by Law Week Colorado, he currently chairs the firm’s Investments & Asset Management Litigation Practice Group and is a member of the Cannabis Law Practice Group, among others. Mike believes deeply in the power of diverse, egalitarian and well-rounded legal teams, in which all members’ life experiences and talents foster entrepreneurial, creative solutions for clients.
Financial Crisis Litigation
For more than a decade, Mike has litigated the fallout from the 2008 financial crisis, including as lead counsel to the Lehman Brothers bankruptcy estate for mortgage-backed securities (RMBS)-related matters. In that role, he defended more than $80 billion in mortgage-related claims brought against the Lehman estate and prosecuted thousands of claims against sellers of defective mortgage loans. Mike has also represented both institutional investors and investment banks in several multibillion-dollar RMBS trials, achieving, in one case, what the New York Post called “a whopping defeat” of an $11.4 billion claim.
Brand and Business Protection
Mike has substantial experience in brand and business protection, both as a preventative strategist and advisor and as a litigator. He has provided counseling and litigated cases involving trade secrets, trademarks and non-compete agreements, and helped clients defend themselves against multiple forms of unfair competition. Mike immerses himself in clients’ businesses to thoroughly understand their goals and challenges and to design comprehensive legal strategies in which litigation is only one of many tools for achieving success.
The legalization of adult use cannabis in Colorado, California and beyond has created a demand for sophisticated counsel who can adapt to ever-changing business and legal environments and provide reliable advice to clients in a field with little legal precedent. In this respect, Mike excels because of his experience handling multibillion-dollar bet-the-company matters, the laser-focus and steady hand he developed in his military and law enforcement service and his aptitude for solving difficult—often novel—legal problems. Clients in the cannabis space (and beyond) benefit from Mike’s personal experience as an entrepreneur and business owner as well as the extensive resources of the firm’s Cannabis Law Practice Group, which is ranked among the nation’s leaders by Chambers USA.
Mike’s cannabis law experience includes conducting internal investigations, litigating and mediating disputes, advising on M&A transactions and consulting on regulatory matters in both Colorado and California. In 2018, Databird Research Journal named Mike one of 250 “Cannabis Law Experts,” and in 2019, Mike was selected by the Colorado Marijuana Enforcement Division to participate in rulemaking under Colorado’s new investment-promoting statute, HB19-1090.
Before Fox Rothschild
Mike served as a combat medic in the Israel Defense Forces and later as a metropolitan Denver area police officer. After graduating summa cum laude from the University of Colorado and first in his class from the University of Denver College of Law, Mike began his legal career with the international law firm of Arnold & Porter, and later formed Rollin Braswell Fisher LLC (RBF Law), for which he was recognized as an Elite Boutique Trailblazer by the National Law Journal. RBF Law merged with Fox Rothschild in June 2018.
Beyond Fox Rothschild
Mike uses his platform to support social justice and public interest organizations, and he maintains an active pro bono practice. Mike supports the Rocky Mountain Immigrant Advocacy Network (RMIAN), the Denver Public Schools Foundation and the Center for Legal Inclusiveness, and is a member of the firm’s Diversity Committee. Mike is particularly focused on empowering women and other underrepresented communities in the legal profession. Mike’s successful pro bono representations include helping secure asylum for an Eritrean torture victim, and to ensure the legal right of a high school gay/straight alliance club to exist and provide support to its student population.
