ABA Blesses Client Disclosure to Facilitate Lateral Moves

When lawyers are looking to make lateral moves, they typically tell their perspective new firms the names of clients they represent for the purpose of conflict checks. And the clients are usually none the wiser.

Proponents of an amendment to Model Rule of Professional Conduct 1.6, which would provide guidelines for how to share this information, say requiring client approval before sharing client lists would be cumbersome and impractical.

Pennsylvania lawyers, including Fox Rothschild’s Abe Reich, played prominently in the debate through their roles as ABA delegates.

Now that the rule has been approved, Reich said, he and other members of the PA and Philadelphia bar associations’ ethics committees will look to pass resolutions to press for its adoption by the Pennsylvania Supreme Court.
