Landlord Groups Fail to Overturn Regulatory Ordinance

A Pennsylvania landlord organization and the Pennsylvania Residential Owners Association have lost their bid before the Pennsylvania Commonwealth Court to broadly invalidate an ordinance imposing affirmative requirements on owners and landlords of Berwick Township rental properties. Steven K. Ludwig, a partner and member of the firm’s Philadelphia office, recently spoke to Pennsylvania Law Weekly about the Commonwealth Court’s decision.

Ludwig told Pennsylvania Law Weekly that the appeal represented "another broad challenge to try and kill these types of ordinances."

Ludwig called the ruling a "very strong opinion from the Commonwealth Court," noting that a number of other boroughs in the state are looking to pass ordinances similar to the one sub judice.

Because of this, Ludwig believes, the case has generated some interest.
