NJ High Court Reins In Defense Against Late-Filed Cases

The New Jersey Supreme Court recently ruled that defendant's can't escape a lawsuit by arguing the plaintiff's delay in filing a suit put them at an unfair advantage as long as the case was filed within the statute of limitations, a decision attorneys say will provide added certainty over the timeliness of cases and limit the use of that commonly pled defense.

Ian D. Meklinsky, a Partner and member of the firm's Labor and Employment Department, spoke with Law360 about the ruling. Meklinsky told Law360, "What they're saying here is that we're not going to penalize people for not accelerating their claims where the state legislature has specifically said this is the time you have to do it in."
