David Snyder successfully represented a property owner whose property was taken by the New Jersey Department of Transportation for the Marlton Circle project. While the New Jersey Department of Transportation said the land, including an essential driveway to a shopping center, was only worth $194,000, the jury at the Mount Holly courthouse awarded $1.6 million to the property owner.
The state argued the driveway was not in use when it took the land, but Snyder argued it could have been, which gives the land more value, “Given the spike in roadway projects around the region, there is likely to be an increase in eminent domain claims involving issues like this."
