Richard S. Caputo, partner and chair of the Nonprofit Organizations Practice at Fox Rothschild LLP, presented “Using Charitable Trusts in Estate Planning: Traps for the Unwary” at the Chester County Estate Planning Council meeting on November 17.
Caputo discussed the basics of charitable trusts and how trustees of charitable trusts can eliminate or reduce the amount of income taxes and excise taxes that charitable trusts pay. Caputo then provided council members with several case studies and analyzed whether the charitable trusts created in the case studies have any income or excise tax compliance issues.
Members of the council include attorneys, accountants, insurance agents, stockbrokers, trust officers, non-profit directors and other professionals in Chester County, Pennsylvania.
Caputo focuses his practice on tax-exempt organizations, trust administration, Orphans’ Court litigation and estate planning. He forms public charities, private foundations and supporting organizations; addresses tax-exempt compliance issues such as self-dealing, taxable expenditure responsibility, excess business holdings and intermediate sanctions; assists corporate fiduciaries in obtaining tax-exempt status for their charitable trusts; represents corporate fiduciaries in Orphans’ Court proceedings; and prepares estate planning documents.
Caputo is experienced in preparing Form 1023 applications, Petitions for Adjudications, Petitions to Terminate, Petitions to Reform, Cy Pres Petitions, Guardianship Petitions and Non-Judicial Settlement Agreements, structuring compensation arrangements and preparing estate planning documents.
A regular speaker on topics concerning charitable trust administration and philanthropy, Caputo regularly presents to tax-exempt clients and corporate fiduciaries and has spoken for the Berks County Bar Association, the Lancaster County Bar Association, the Lehigh County Bar Association, the Bucks County Bar Association, the Lehigh County Estate Planning Council, the Chester County Bar Association, the Chester County Estate Planning Council, the Montgomery County Estate Planning Council, the Philadelphia Estate Planning Council, the Committee of Banking Institutions on Taxation, the Fiduciary Education Foundation, the PBA Wealth Management & Trust Conference, the Pennsylvania Bar Institute and the Partnership for Philanthropic Planning of Greater Philadelphia.
Caputo is a member of the American Bar Association and its Tax-Exempt Organizations Committee, the Pennsylvania Bar Association and the Berks County Bar Association. A resident of Berks County, he is a member of the advisory board of The Pennsylvania State University Berks Campus, is the president and a director of The Berks County Chapter of the Pennsylvania State University Alumni Association and is a director of the Wilson Education Foundation.
Caputo received his LL.M. in Taxation from Villanova University School of Law in 2001, his J.D. from The Dickinson School of Law in 1997 and his B.S. from The Pennsylvania State University in 1994.
