In Louis v. Harris, the New Jersey Supreme Court ruled that the state constitution guaranteed same-sex couples “every statutory right and benefit conferred on heterosexual couples through civil marriage.” The Court directed the Legislature to provide this guarantee by either amending the marriage statutes to recognize same sex marriage or enacting an appropriate statutory structure. On December 21, 2006 Governor Corzine signed legislation complying with the Court’s mandate. This article discusses the employment effect of the new legislation on a variety of employment related issues including employee benefits and related tax issues.
